Terms of Service

These Terms of Service ("Terms") govern your use of the Dankbar mobile application ("App"), developed by Robin Weser ("we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) The App

Dankbar is a gratitude journaling app designed to work offline. The App stores your content locally on your device. We do not provide user accounts or cloud services for Dankbar.

2) Eligibility

You must be able to form a legally binding agreement in your country to use the App. If you are under the legal age required to consent, you may use the App only with permission from a parent or legal guardian.

3) License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App for your own personal, non-commercial use, subject to these Terms and applicable laws. You agree not to:

  • copy, modify, distribute, sell, lease, sublicense, or transfer the App or any part of it, except as permitted by law
  • reverse engineer, decompile, or attempt to extract source code from the App, except where such restriction is prohibited by law
  • use the App in any way that violates applicable laws or regulations
  • interfere with or bypass security features of the App

4) Your content

4.1 Ownership

You own the content you create in the App, including journal entries and audio recordings ("User Content"). Because the App is offline, your User Content remains on your device unless you export or share it.

4.2 Responsibility

You are responsible for:

  • the content you create and store in the App
  • maintaining access to your device
  • any files you export from the App (e.g., JSON exports)
  • protecting exported data (for example by storing it in an encrypted location)

4.3 Export and sharing

If you export or share data, you understand that the data may become accessible to third parties depending on the apps/services you use to share or store it.

5) Purchases (free app + future one-time purchase)

The App is currently free. In the future, we may offer a one-time in-app purchase to unlock additional features ("Pro").

If you make a purchase:

  • purchases are processed by your app store provider (e.g., Apple App Store or Google Play), not by us
  • your purchase is subject to the app store’s terms and policies (including refunds)
  • we do not control the app store’s billing, refund, or account processes

If Pro features become available, we may change which features are included in the free or Pro version over time, but we will aim to do so fairly and reasonably.

6) Updates and changes

We may release updates to improve the App (for example, bug fixes, performance improvements, or new features). The App may not function properly without installing updates. We may modify, suspend, or discontinue parts of the App at any time. If we discontinue the App, you will still be able to keep your local data on your device unless you delete it, but functionality may be affected by OS changes over time.

7) Disclaimers

7.1 "As is"

The App is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the App will be error-free or uninterrupted.

7.2 No medical or professional advice

The App is for personal journaling and self-reflection only. It does not provide medical, psychological, legal, or other professional advice. If you need professional help, seek a qualified professional.

7.3 Device backups

Depending on your device settings, your operating system may back up app data (e.g., iCloud / Google backup). This is controlled by your device and account settings, not by Dankbar.

8) Limitation of liability

To the maximum extent permitted by law:

  • we will not be liable for any indirect, incidental, special, consequential, or punitive damages
  • we will not be liable for loss of data, loss of profits, or loss of device access
  • our total liability for any claim relating to the App will not exceed the amount you paid for the App (if any) in the 12 months before the event giving rise to the claim (or, if you paid nothing, €0)

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

9) Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from:

  • your use of the App in violation of these Terms
  • your violation of applicable laws
  • your User Content or how you export/share it

10) Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend your license to use the App if you materially breach these Terms. Upon termination, you must stop using the App.

11) Governing law

These Terms are governed by the laws of Germany, excluding its conflict of law rules. If you are a consumer in the EU, you may also benefit from mandatory consumer protection laws in your country of residence.

12) Changes to these Terms

We may update these Terms from time to time. If we make changes, we will update the effective date and publish the updated Terms where they are made available (for example on the App's website or in the App). Your continued use of the App after changes means you accept the updated Terms.
